Board of Trustees Meeting of June 14, 2004

A regular meeting of the Board of Trustees was held in the Clubhouse on June 14, 2004. All Board Members and Flag Officers were present with the exception of PC Crows who was excused. V/C McCroskey was designated by Board Chairman Packard to vote in his stead.

CALL TO ORDER: A quorum being present, Chairman Packard called the meeting to order at 1900 hours.

MINUTES OF THE PREVIOUS MEETING: Secretary Stone read the minutes, which were approved as read.

MEMBERSHIP REPORT: Captain Bressler presented and the Board approved applications for Club membership from Joel Norman, Steve Weiss, Paul Stocklin, Richard Key, Vince Firlotte, Richard Fisch and Nicholas Lesnikowski. It was moved and seconded to approve an application from John Lukjanowicz subject to his attending the next general meeting.

TREASUER'S REPORT: Captain Farber reported:

  • Income to date is on target. Dues revenue is down but has been off set by new member revenue.
  • A new computer and printer for the office will be purchased in the near future.
  • Legal and Accounting expense increased as a result of an invoice from our former accounting service for the 2002 tax period.
  • Ship Stores inventory is shown at $10,000. A request has been made for an additional $1,000 to restock inventory. Captain Farber recommended the Board develop a protocol for managing these funds and will discussion it with the planning and finance committee.
  • Expenses for opening day exceeded revenue by $500.
  • The two remaining bonds have been retired.
  • Captain Farber discussed the Junior Boating Program accounting entry.

BOARD CHAIRMAN'S REPORT: Chairman Packard – No report

COMMODORE'S REPORT: Commodore Anhalt reported: He and Captain Wood presented the $2,500 gift certificate to the Bainbridge Fire Department to be used for electronics on their new fireboat. The gift certificate was purchased from Lunde Electric, Seattle.

VICE COMMODORE'S REPORT: V/C McCroskey reported:

  • The Milfoil application budget was $9,000. The application process has been completed. The actual expense was $6,900.
  • The Outstation piling replacement is on schedule for the end of this July.
  • The Junior Boating Program has 11 applicants to date.
  • A review of the cost to print and mail the Bilge Pump has been undertaken.

Moorage Rules changes were presented by the Moorage Rules Committee, which is composed of V/C McCroskey, R/C Grimm, P/C Ewell, Captains Art Malden and Jerry Zuvich. (See the Attached Draft) A discussion amongst the board members and several members present ensued. The following issues were discussed:

  • Fleet measurement standards
  • Qualifying boat length
  • Slip measurement
  • Methods of notifying members of moorage availability
  • Number of days a Captain will have to respond to the moorage committee
  • Measurement of all vessels on the Move and Waiting lists
  • Several changes to the draft proposal were made
  • The Moorage Rules Committee will post the revised draft on the web site
  • October 1, 2004 was discussed as the target date for rule change implementation

Members present to discuss the proposed rules changes included: Captains Bob Yates, Jim Bailey, Eric Turloff, Tim McCarthy, Randy Jamerson, Art Mauldin, Darren Emmens, William G. McGillin, Ken Klett and Bill Bressler. No action whatsoever was taken regarding the proposed moorage rule changes. They will be further reviewed at a future meeting.

REAR COMMODORE'S REPORT" R/C Scott Grimm: No report

OLD BUSINESS: None

NEW BUSINESS: Nome

MEMBER COMMENTS: A letter to Board Chairman Packard dated June 12, 2004 was received from Captain Almo. In the letter he expressed his dissatisfaction with current Club leadership and the manner in which moorage assignments are made. All Board members read the letter.

Draft Moorage Rule Changes

For review at the June 14, 2004 Board Meeting

3. Permanent Moorage.

3.01. Definitions. Permanent moorage means the privilege extended to Active Members of the Club for exclusive use of a slip or dock space for moorage of a boat in accordance with these Moorage Rules. A Mooring Member shall mean a Club member to whom the privilege of permanent moorage has been assigned. A Non-mooring Member means a Club member who has not been assigned the privilege of permanent moorage.

3.02. Qualification for Permanent Moorage. Only boats which are owned by Active Members of the Club, have a current state registration, are 65 feet or less in length and have permanently installed cooking facilities, bunks or berths and a head qualify for permanent moorage. Ownership of a boat means that title to the boat is in the name of an Active Member or jointly in the name of one or more Active Members as shown by the Washington State certificate of ownership or the Coast Guard documentation for the boat. A person has no permanent moorage privilege simply because the person is a spouse or relative of a Club member who has permanent moorage privileges. No member may be assigned permanent moorage for more than one boat.

3.03. Slip Categories and Lengths. Boat slips shall be divided into categories by length. Boats shall be categorized by the Moorage Committee and assigned based on the definition of boat length. A boat may only be placed in a slip that qualifies based on its length, except that with the written approval of the Vice-Commodore, the Moorage Committee may position a boat in a temporary slip until a qualifying slip becomes available. All covered slip lengths shall be measured to the drip line of the cover. Moorage in a slip shall be assigned only to a boat that is qualified for permanent moorage and the length of which is not less than the minimum, if any, nor more than the maximum for the slip.

For covered moorage, the maximum length allowed in a slip shall be the drip line plus two (2) feet. For all covered moorage except 39' slips on Dock 3 and 54' slips, the minimum length shall be the length of the pier. 39' slip assignments on Dock 3 shall have no minimum length. The minimum length for 54' slips shall be 48'. For open moorage, the maximum length allowed shall be the pier length plus five (5) feet. The minimum length allowed shall be the pier length. Slip lengths and maximum/minimum lengths shall be identified as follows:

3.04. Boat Length. Boat length shall be measured from the tip of the bow, or from the manufacturer's pulpit or bow roller, whichever is furthest fore, to the furthest aft edge of the swim step. Dinghies, dinghy davits, non-manufacturer pulpits or bow rollers, or other attachments to the hull shall not be included in determining the boat length. No boat moored at any of the covered floating docks shall extend beyond the drip line of the roof of the dock. The Fleet Measurer or Moorage Committee measurer shall measure the length, the width, and the height of each boat and record those measurements with the Committee. Included in the measurements shall be the overall length for billing purposes.

3.05. Priority List. For each category of boat slip, the Committee shall maintain a priority list of no more than 25 eligible members who own a boat qualifying for permanent moorage and who have requested permanent moorage for the category of slip. Highest priority on the list shall be assigned to the member with the lowest membership number. At least once each 60-day period, an updated copy of each priority list shall be posted on a bulletin board at the clubhouse. The posted copy shall indicate the date to which it is current. A posted copy need not be updated or kept current until the next updated copy is to be posted. The Committee shall maintain in its possession the only updated and current priority lists.

3.06. Application for Priority Listing. An Active Member who desires to be included on a priority list for permanent moorage of a boat shall submit a written application or email to the Committee requesting that the member be listed and provide (a) the member's membership number, (b) the approximate length and beam of the member's qualifying boat, (c) proof of current state registration, (d) proof of ownership of the qualifying boat, (e) a current email address and telephone number(s), and (f) any other information the Committee considers to be needed to establish the member's qualification and priority. Properly qualified members who make application shall be added to the priority list for the category of slip desired. Each member desiring permanent moorage is responsible for making a proper application and confirming that the member is placed on the priority list for the category of slip for which the member is eligible. Requests for corrections to any priority list shall not be considered unless made in writing to the Committee. Each member desiring permanent moorage is responsible for keeping the Committee current on all email addresses and telephone numbers for contact. No member shall be included on a priority list until the member's boat has been measured by the Fleet Measurer or Moorage Committee measurer.

3.07. Assignment of Slips. Assignments of permanent moorage in each slip category shall be made only to a member who is on the priority list used for the slip category. If a member is not on the priority list at the time that a slip becomes available, the member will not be entitled to assignment of permanent moorage at that slip. The Committee shall have no obligation to give any notice to any member concerning availability of slips for assignment, except that when a slip in a category becomes available, the Committee shall contact the member by email on the priority list used for that category with the highest priority to ascertain whether the member desires to accept the assignment. If a member accepts the slip, permanent moorage at the slip shall be assigned to the member. If the member declines an offer of a slip assignment of the size and type requested, or fails to respond within _____ days of the email notification's send date and time stamp, then such member's name shall be removed from the priority wait or move list. The member may reapply for moorage when the member is ready to take a slip. The slip will be offered to the member with the next priority on the priority or move list used for that slip. Assignments made for permanent moorage during each past two-month period shall be posted at the clubhouse by the Committee. Priority for permanent moorage is not affected by sub-assignments of permanent moorage.

3.08. Loss of Permanent Moorage. On termination of the privilege of permanent moorage, a boat shall be immediately removed from the slip. A Mooring Member's privilege of permanent moorage may be terminated by the Committee in the event of any of the following:

3.08.01. No Boat. The Mooring Member's qualifying boat is not moored in the slip assigned to the Mooring Member within 30 days after assignment of the slip is made.

3.08.02. No Occupation. The Mooring Member's qualifying boat does not occupy the slip for at least six months of each calendar year. On application by the Mooring Member prior to the expiration of the six months, the Board of Trustees may extend that six month period on showing of special circumstances justifying the extension in the discretion of the Board of Trustees.

3.07.03. Change of Owner. Six months after transfer of ownership of Mooring Member's boat, during which time, the slip shall be made available for sub assignment.

3.08.04. Death. Six months after the death of the Mooring Member.

3.08.05. Inactive Boat. The Committee determines that, historically and presently, the Mooring Member's boat has not been, and is not being, used by its member owner for cruising or Club functions away from moorage facility, that there is no reasonable expectation that the boat will be so used, or that the boat is not maintained as a seaworthy yacht.

3.08.06. No Registration. The boat has no current Washington state registration.

3.08.07. Suspension. Membership has been suspended.

3.09. Joint Ownership. If the boat for which permanent moorage has been assigned is jointly owned by more than one Active Member, the joint member with the highest membership number shall be used to determine priority and qualification for permanent moorage of the boat. Married couples that individually have memberships shall be exempt from this requirement. Joint owners shall promptly notify the Committee of any joint ownership or change in joint ownership of a boat.

3.10. Sub Assignments. No Mooring Member may make a sub-assignment of the member's permanent mooring privilege. If a Mooring Member informs the Committee in writing of the period when the Mooring Member's assigned slip will be empty and requests sub-assignment, the Committee may sub assign the privilege of exclusive moorage at that slip temporarily to another member for a period of not more than six months. A member who desires to obtain a sub assignment of a slip shall make a request in writing to the Committee setting forth the member's membership number, the name of the qualifying boat, its overall length, beam and height above the waterline and category of slip desired. Sub assignments shall be made to members who have requested sub assignments and who have the lowest membership number, except that members who have been assigned off-season moorage at the Eagle Harbor Outstation within the past twelve months shall have priority over those members who have not been assigned such moorage. When the Committee makes a sub assignment, it shall notify each of the members involved by mail. During the period of sub assignment, the member who receives the sub assignment shall be responsible for the payment of no more than the moorage and utility charges for permanent moorage at the slip incurred during the sub-assignment period.

3.11. Changes of Slip Assignment. No change of a slip assigned for permanent moorage shall be made by Mooring Members. A Mooring Member desiring to move to a different slip shall give the Committee written request.

3.12. Billing. For billing purposes, covered moorage shall be billed to the drip line, or by the length of the boat, whichever is greater. Open moorage shall be billed by the length of the pier, or by the length of the boat, whichever is greater.
